How To Afford A Life After Divorce

Domestic Violence Appellate Decision

The New Jersey Lawyer reports that the Appellate Division has decided (but has NOT published its decision) the case of Rider v. Byrnes (Docket No. A-405-04T2, August 24, 2005). The New Jersey Lawyer reports that:

"Final domestic violence restraining order against the defendant ex-boyfriend reversed and remanded for vacation of the FRO; the plaintiff ex-girlfriend asserted that the ex-boyfriend had posted harassing material on his Web site, and the defendant claimed that the allegedly harassing statements were lyrics to a song that his band wrote, were not directed to a specific person, and were not communicated to the ex-girlfriend; the trial court erred by determining that the ex-boyfriend had committed an act of harassment because there was no evidence that he had communicated the statements to the ex-girlfriend; the ex-boyfriend’s posting of material that may have referred to the ex-girlfriend on his Web site by itself did not provide a legal basis for the entry of the FRO."

Credit Reports

Fort Lee and NYC Attorney/Mediator Elaine H. Nissen, Esq. reported on a Mediator's Email List that: Beginning September 1st, the three nationwide credit bureaus (Equifax, Experian and Transunion) will have unified toll-free telephone number, website and mailing address to order credit reports. The Fair Trade Credit Reporting Act requires one free consumer credit report per 12-month period.

Toll-free: 1-877-322-8228

Mail (complete a Form and send it to):
ANNUAL CREDIT REPORT REQUEST SERVICE
PO Box 105281
Atlanta, GA 30348-5281

If anything doesn't look right the three bureaus need to be contacted immediately and they must by law address your concerns and fix what turns out to be errors - contact info will arrive with the credit reports.

This is a lot easier than the former procedure of contacting the three bureaus separately.

Photographers Beware

In the August 7, 2005 edition, The Star-Ledger, in a story titled: A portrait of artistic expression vs. a right to privacy, reports about a lawsuit pending in New York stemming from a book of photographs taken by Philip-Lorca diCorcia [ISBN: 3882434414; Published October 2001 by Steidl, Gerhard Druckerei und Verlag]. The Plaintiff is Erno Nussenzweig, who believes he has been damaged by the unauthorized printing of his portrait in an art book that is being sold commercially.

Domestic Partners May Not Be Discriminated Against On The Basis Of Marital Status

The Supreme Court of California ruled, on August 1, 2005, in Keobke v. Bernardo Heights Country Club, that a business that extends benefits to spouses but denies those benefits to domestic partners registered under California’s Domestic Partner Act engages in impermissible marital status discrimination.
